Order conditions

1.Scope and validity of ordering terms

1.1. These Terms and Conditions (hereinafter the Ordering conditions) apply to Expert Eesti OÜ (hereinafter Expert), registry code 10090323, address Mustamäe tee 16, Tallinn; when buying goods available for sale on the internet shop (www.expert.ee) by the customer (hereinafter Client).

1.2. The Parties shall be guided in their relations with the Ordering Conditions, the Expert Price List and current legislation of the Republic of Estonia.

2. Entry into the Agreement

2.1. Purchase and sales contract for ordered goods is deemed to have been entered into after the order has been placed by the Customer and the order confirmation is sent by Expert.

2.1.1 To order goods, you must add the desired products to the shopping cart. To complete the order, fill in the required data fields and choose the appropriate delivery method. The amount of the fee can then be displayed, which can be paid via a bank link or other payment solution.

2.1.2 The Agreement shall enter into force on the receipt of the amount due to the Expert e-store account and if the Customer has been issued an original invoice.

3. Prices of goods and services, pictures

3.1. The prices for the goods are in euros and include VAT.

3.2. Expert reserves the right to make corrections in the prices of the goods by informing about it on the website in means by updating prices.

3.3. In the absence of a price or a 0 euro price (or the exact price of the item in the database), please contact us by phone or e-mail. The corresponding order will be corrected and the confirmation sent to the Customer as soon as possible.

 3.4. The product images presented on the website are for illustrative purposes only and may not always correspond exactly to the product. Expert  does not guarantee the exact conformity of the goods to the pictures.

4. Means of payment for goods

4.1. When paying via the bank link (Montonio), you must choose a suitable bank from the list when you place an order (Swedbank, SEB, LHV, Coop Pank or Nordea). After confirmation of the order, you will be directed directly to the Internet bank, where you will receive a pre-filled payment order.  

4.1.1 Be sure to click "Back to Merchant" after making a payment with the bank link. Otherwise, it may not be possible for us to know that the payment has been made successfully, and your order will be delayed.

4.2 Paying by installments

Before concluding a transaction, please refer to the detailed terms and conditions of the installment payment purchase and consult a professional if necessary. 

4.2.2 A response to an installment payment application, whether positive or negative, will be provided to the customer immediately.

4.2.3 Installment payment can be made without a deposit and with a first deposit. If you accept a positive decision and the terms and conditions of the Expert purchase, we will send you an invoice for the first installment, which you can pay immediately through the bank link and after that we will send you the Agreement digitally for signing. A link to a pending signing contract will be sent to the email address you specify, if for some reason it is impossible to sign the contract immediately online, you can do so after by the email link sent.

4.2.4 The first installment must be paid from the settlement account of the installment payment applicant.

4.2.5 The digital signature requires the existence of an ID card or a mobile ID. Before signing, check the validity of your ID card certificates and software updates on your computer. If the system still gives an error about the ID card, look for a solution HERE

4.2.6 Expert reserves the right to withdraw from the positive response to the installment payment application and refuse to enter into a hire purchase agreement if it becomes evident that the Customer has submitted false information, liquidation or bankruptcy proceedings have been initiated against the Customer, an active debt claim against the Customer has been opened or some other material fact emerges, which makes it impossible to conclude a hire purchase agreement.

5. Shipping

5.1 The transport providers of the Expert e-store are Omniva, DPD, Itella and Venipak and the courier services of Expert's cooperation partners. The customer can also pick up the goods at Expert store that suits them.

5.1.1 The goods will be sent by DPD courier to the address chosen by the Customer. Goods and services are paid 100% by bank transfer or installment payment agreement.

5.1.1.1 Products shipped by the parter courier services will be delivered to the customer in front of the house. Goods and services are paid 100% by bank transfer or installment payment agreement.

5.1.2 The goods are sent to the parcel terminal chosen by the Customer by SmartPost, Omniva or DPD Pickup. The customer must pick-up the package within 7 days when the goods arrive at the parcel machine. Goods and services are paid 100% by bank transfer or installment payment agreement.

5.2 Inland shipments generally reach the destination specified by the buyer within 1-5 working days from the entry into force of the sales contract. In exceptional cases it is possible to deliver the goods within 45 calendar days.

5.2.1 The delivery time for a product in stock is  normally 1-3 working days. Otherwise the delivery time is up to 10 working days

6. Availability of goods

6.1. The availability of the goods is provided in the information describing the goods. Data on the website is updated as quickly as possible, and due to time delays and possible inaccuracies between the database and actual inventory of Expert and vendor inventory, Expert cannot guarantee the availability of the goods. Upon occurrence of such situations,  Expert shall immediately inform the Client and further execution of the order shall be agreed upon according to the wishes of the Client and the possibilities of Expert.

7. Customer's right of withdrawal

7.1. The Customer shall have the right to withdraw from the Purchase and Sale Agreement concluded on the basis of the order of the Expert Online Shop within 14 days after the delivery of the ordered goods to the Customer.

7.2. In order to use the 14-day right of return, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods as they are permitted to be tested in the physical shop. The returned goods must not be used and must be labeled in their original packaging and have all the original labelling.

7.3 To return the goods, you must submit an application for the withdrawal of the goods and send it to e-pood@expert.ee, no later than 14 days after the receipt of the goods.

7.4 Purchased goods cannot be returned if the ordered product is customized according to the customer's personal needs or according to the terms and conditions provided by the customer.

7.5. For hygiene reasons, we do not accept returns for headphones and bodycre products.

7.6. Returning purchased Goods to the parcel machine costs € 2,99 and goods can be returned with a receipt code sent to the customer via email or mobile text (Omniva and Itella SmartPost). Returning the goods to the store is FREE. Return of goods sent by DPD courier is subject to a fee. A small pack costs € 10,90 and a large pack, such as a washing machine costs € 19,90. 7.7 The cost of returning the goods shall be borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to the order.

7.8 The Expert online shop returns the amount paid for the goods to the Client upon cancellation of the contract as soon as possible, but not later than within 14 days from the withdrawal from the bank account indicated by the Client (the goods must be returned or the customer must prove that the returned goods have been returned). The amount to be returned will be offset to the extent that it overlaps with the fee for returning the goods to be paid by the Customer, which Expert e-shop has paid for the Customer.

8. Expert right to withdraw 

8.1 Expert online shop has the right to withdraw from the sales transaction and demand the goods from the buyer if the price of the goods in the online shop is significantly lower than the market price of the goods due to an error occured.

8.2 The Expert online shop has the right to withdraw from the purchase and sale contract concluded on the basis of the order if the Customer has not paid the invoice within the time indicated on the invoice or if the Expert's stock of the corresponding goods has expired.

9. Right of claim

9.1. The deadline for submitting complaints to the products is in accordance with the procedure prescribed by law (VÕS).

9.2. The deadline for submitting complaints is only valid with the purchase invoice.

9.3. The deadline for submitting a complaint does not apply if the defect is caused by improper use of the product, failure to observe the maintenance manual or instruction manual or wear of the product.

10. Ownership reservation

10.1. Until the price of the goods is fully paid, the goods are the property of Expert.

11. Collection and use of personal data

11.1. Expert uses the personal data (including name, phone number, address, e-mail address, bank details) entered by the Client only for processing the order and sending the goods to the buyer.

Expert transmits personal information to transport companies in order to deliver goods.

11.2. Expert will use the Customer's contact information to forward the advertisement and other information to the Client only if the Client is aware of it and has given permission to forward such information.

11.3 The Customer may at any time waive the offers and newsletters sent to the e-mail by informing Expert by e-mail or following the instructions in the e-mail containing the offers.

12. Changes to ordering conditions and pricelist

12.1. Expert has the right to amend and supplement these terms and conditions.

12.2. Changes and modifications to the Terms and Conditions and the Price List shall be announced on the website www.expert.ee and the amendments and additions to the Terms and Conditions and Price List shall take effect upon the publication of the corresponding amendment or amendment.

12.3. If the order is submitted before the terms and conditions and the price list changes, the terms and price list valid at the time of placing the order will apply to the Client.

13. Supervisory Authority and Disputes

13.1. The Consumer Disputes Commission, which operates at the Consumer Protection Board, has supervisory competence over the contracts concluded under the terms of the order. Further information can be obtained from the Consumer Protection Commission 1330 or 6 201 707.

13.2. The Customer has the right to file a complaint with the Consumer Complaints Committee or the European Union Online Dispute Resolution Platform or the ODR platform at  http://ec.europa.eu/odr.

14. Final provisions

14.1. The laws of the Republic of Estonia apply to these Ordering Terms and Purchase and Sales Contracts.

14.2. If any of the terms and conditions of the ordering terms are neglect, it will not affect the validity of the ordering terms and the purchase agreement. An empty provision is replaced by a legal provision that is legally and economically the closest to a negligible provision.

After the purchase agreement has been signed, the order terms will remain available at  http://www.expert.ee
